Terms of service

Sale is permitted only in commercial quantities and to private buyers.

1) Scope

These General Terms and Conditions (hereinafter "GTC") of loveU.de (hereinafter "Seller") apply to all contracts that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods and/or services displayed by the Seller in its online shop. The inclusion of the Customer's own terms and conditions is hereby rejected unless otherwise agreed upon.

A consumer in the sense of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly outside their commercial or independent professional activity. An entrepreneur in the sense of these GTC is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2) Conclusion of Contract

The product descriptions contained in the Seller's online shop do not constitute binding offers from the Seller but are intended for the Customer to make a binding offer.

The Customer can submit an offer via the online order form integrated into the Seller's online shop. By placing the selected goods and/or services in the virtual shopping cart and completing the electronic order process, the Customer makes a legally binding offer to conclude a contract for the goods and/or services in the shopping cart by clicking the final order button. Alternatively, the Customer may also submit an offer to the Seller by email.

The Seller may accept the Customer's offer within five days by providing a written order confirmation or an order confirmation in text form (email), with the receipt of the order confirmation by the Customer being decisive, or

by delivering the ordered goods to the Customer, with the receipt of the goods by the Customer being decisive, or
by requesting payment from the Customer after the order has been placed.
If several of the aforementioned alternatives apply, the contract is concluded at the moment one of the aforementioned alternatives occurs first. If the Seller does not accept the Customer's offer within the above period, this shall be deemed a rejection of the offer, and the Customer is no longer bound by their declaration of intent. If the Customer does not pay within ten days in the case of advance payment, the order will be automatically canceled.

The acceptance period begins the day after the Customer's offer has been sent and ends at the close of the fifth day following the offer's dispatch.

When submitting an offer via the Seller's online order form, the contract text is stored by the Seller and sent to the Customer after submitting their order together with the GTC in text form (e.g., by email). Additionally, the contract text is archived on the Seller's website and can be accessed free of charge by the Customer through their password-protected account if they created an account before submitting their order.

Before the binding submission of the order, the Customer can continuously correct their entries using the usual keyboard and mouse functions. Additionally, all entries are displayed in a confirmation window before the final order submission and can be corrected there as well.

The only language available for the conclusion of the contract is German.

Order processing and contact usually take place by email and automated order processing. The Customer must ensure that the email address they provided for order processing is correct so that they can receive emails sent by the Seller at this address. When using spam filters, the Customer must ensure that all emails sent by the Seller or third parties involved in order processing can be delivered.

3) Right of Withdrawal

Consumers generally have a statutory right of withdrawal.

The right of withdrawal does not apply to consumers who, at the time of concluding the contract, are not members of a European Union member state and whose sole place of residence and delivery address is outside the European Union.

4) Prices and Payment Terms

Unless otherwise stated in the product description, the prices listed by the Seller are total prices, including statutory VAT. Any additional delivery and shipping costs are specified separately in the respective product description.

For deliveries to countries outside the European Union, additional costs may be incurred in individual cases that the Seller is not responsible for and must be borne by the Customer. These include, for example, costs for money transfers through credit institutions (e.g., transfer fees, exchange rate fees) or import-related taxes (e.g., customs duties). Such costs may also apply to money transfers if the delivery is not made to a country outside the European Union, but the Customer makes the payment from a country outside the European Union.

The Customer has various payment options available, which are listed in the Seller's online shop.

If prepayment by bank transfer is agreed, payment is due immediately upon contract conclusion. If payment is not received within 7 days, loveU.de reserves the right to cancel the order.

Payment options are provided to the Customer in the Seller’s online shop.

For payments processed through PayPal, transactions are handled by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), under PayPal's terms, accessible at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or, for customers without a PayPal account, under terms for payments without a PayPal account at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.

5) Delivery and Shipping Terms

The delivery of goods is carried out by shipping to the delivery address specified by the Customer unless otherwise agreed. The address provided during the Seller's order process is decisive.

For items delivered by freight forwarders, delivery is "curbside," meaning to the nearest curb at the delivery address, unless otherwise specified in the Seller's shipping information and unless otherwise agreed.

If the shipping company returns the goods to the Seller due to unsuccessful delivery, the Customer bears the cost for the unsuccessful shipment, except if the Customer effectively exercises their right of withdrawal, is not responsible for the failed delivery, or was temporarily prevented from accepting the service.

In compliance with the EU General Data Protection Regulation Article 6(1f), we may transfer your data (name, address, email address, and/or mobile number, along with shipping-related data) to our shipping partner DPD Deutschland GmbH. You can object to the transmission of additional information, such as email or mobile numbers, by contacting us at love Sports Solutions UG, Marcobrunner Str. 1, 65197 Wiesbaden or directly with DPD at widerspruch_predictbenachrichtigung@dpd.de.

6) Retention of Title

If the Seller delivers in advance, they retain ownership of the delivered goods until the owed purchase price is paid in full.

7) Liability for Defects (Warranty)

If the purchased item is defective, the statutory defect liability provisions apply.

The Customer is asked to report any obvious transport damage to the carrier and inform the Seller. Failure to do so has no effect on the Customer's statutory or contractual claims.

8) Redemption of Promotional Vouchers

Vouchers issued by the Seller as part of promotions with a specific validity period and that cannot be purchased by the Customer ("promotional vouchers") can only be redeemed in the Seller's online shop during the specified period.

Certain products may be excluded from the voucher promotion if indicated on the voucher.

Promotional vouchers can only be redeemed before the order process is completed. Subsequent crediting is not possible.

Only one promotional voucher can be redeemed per order.

The value of the goods must equal or exceed the value of the promotional voucher. Any remaining credit will not be refunded by the Seller.

If the value of the voucher is insufficient to cover the order, one of the remaining payment options offered by the Seller may be used to settle the difference.

The balance of a promotional voucher is neither paid out in cash nor earns interest.

The promotional voucher will not be refunded if the Customer returns goods wholly or partially paid for with the promotional voucher as part of their statutory right of withdrawal.

The promotional voucher is transferable. The Seller can provide payment to the respective holder redeeming the promotional voucher in the Seller's online shop with discharging effect.

9) Applicable Law

All legal relations between the parties are governed by the laws of the Federal Republic of Germany to the exclusion of the laws governing the international sale of movable goods. For consumers, this choice of law applies only insofar as the protection provided is not revoked by mandatory provisions of the law of the country in which the consumer is habitually resident.

This choice of law does not apply regarding the statutory right of withdrawal for consumers who, at the time of contract conclusion, do not belong to a member state of the European Union and whose sole residence and delivery address are outside the European Union.

10) Jurisdiction

If the Customer is a merchant, a legal entity under public law, or a special fund under public law with its seat in the territory of the Federal Republic of Germany, the exclusive jurisdiction for all disputes arising from this contract shall be the Seller's place of business. If the Customer's seat is outside the Federal Republic of Germany, the Seller's place of business is the exclusive jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the Customer's professional or commercial activity.

11) Information on Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at http://ec.europa.eu/consumers/odr. This platform serves as a point of entry for the out-of-court settlement of disputes arising from online sales or service contracts involving a consumer.

loveU.de may contact you by email to invite you to review the service and/or products you received from us, to gather your feedback and improve our service. We work with the external company Trustpilot A/S ("Trustpilot") to collect customer feedback, so we will share your name, email address, and reference number with Trustpilot.
